TRANSFER OF TEACHERS
Refer to Article 7.3 of the Agreement Between the City School District of Schenectady and the Schenectady Federation of Teachers.
Voluntary Transfer Process
A tenured member who has not made a voluntary transfer in the previous two school years, is not currently on a T.I.P. and has not received more than one counseling memoranda based on the same area of concern will be eligible to participate in the district voluntary transfer process.
The voluntary transfer process applies to vacancies that involve a change to a building assignment which may result in an assignment to the same grade or subject, or to a different grade or subject, provided that such change is in the same tenure area.
Any eligible member wishing to participate in the voluntary transfer process shall indicate their interest by applying to the vacancy posting and completing a questionnaire detailing their qualifications. Such questionnaire shall be collaboratively developed.
Where there is more than one applicant, there may be a follow-up discussion with the administrator(s) to evaluate the candidates in accordance with the selection criteria identified in 7.3.2.
Involuntary Transfer Process
Notice of an involuntary transfer or reassignment shall be given pursuant to Section 7.2.1.
A.In case of a need to reduce staff in a given building, the employee selected for involuntary transfer shall ordinarily be the member in the tenure area with the least service with the district. Such members shall have the right to participate in the voluntary transfer process notwithstanding the eligibility requirements set forth in 7.3.1(a).
When a building is closed or a member is involuntarily transferred or reassigned, those members shall retain the building seniority rights they had accrued prior to the transfer.
A member who has been involuntarily transferred had the right to request a meeting with their supervisor to discuss the reasons for the transfer.
When the district chooses to make an involuntary reassignment for reasons other than a reduction in a given building, there will first be a meeting with the unit member, their representative and the Assistant Superintendent in charge at which time the member will be notified of the reasons thereof.
A displaced unit member shall have the first right to return to the same building in the event a vacancy occurs in that building subsequent to the displacement for vacancies through September 1.
There shall be no involuntary transfer from one tenure area to another.
